CalmApply Terms of Service

Welcome to CalmApply. These Terms of Service ("Terms") govern your access to and use of CalmApply’s website, Chrome Extension, dashboard, and any related services or applications (collectively, the “Service”). By accessing or using CalmApply, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Overview

CalmApply helps users fill out job application forms automatically using information they provide, including resume data, cover letters, and answers. The Service may also use AI tools, including OpenAI APIs, to generate or format responses on your behalf. CalmApply is provided by its operators ("we," "us," or "our") as a software tool to simplify the job application process.

2. Eligibility

You must be at least 18 years old to use CalmApply. By using the Service, you represent that you are legally able to enter into these Terms and are using the Service for lawful purposes.

3. Accounts and Access

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Do not share your credentials with others.

4. Paid Subscriptions

CalmApply offers three subscription tiers through Stripe. Fees, billing intervals, and included features are displayed at checkout. By subscribing, you authorize CalmApply and Stripe to charge your payment method according to your selected plan. All payments are non-refundable except as required by law.

We may modify pricing or features at any time with notice. Subscription upgrades take effect immediately, while downgrades or cancellations will apply to the next billing cycle.

5. Use of AI and Automation

CalmApply may use AI models to autofill or suggest text in job applications. You are solely responsible for reviewing, editing, and submitting any content produced or filled on your behalf. We do not guarantee accuracy, suitability, or acceptance of applications submitted through the Service.

6. Data You Provide

You retain ownership of the information and documents you upload (such as resumes, cover letters, or form inputs). By submitting content, you grant CalmApply a non-exclusive, worldwide, royalty-free license to process, store, and use that data solely to operate and improve the Service.

You are responsible for ensuring that any data you upload complies with applicable privacy, employment, and intellectual property laws.

7. Intellectual Property

All software, trademarks, and content on the CalmApply platform (excluding user-generated content) are owned or licensed by CalmApply. You may not copy, modify, or redistribute any part of the Service without our written consent.

8. Prohibited Conduct

• Reverse-engineering or scraping the Service or its code.
• Using CalmApply to submit spam or fraudulent job applications.
• Uploading malicious code or attempting to gain unauthorized access to our systems.
• Misrepresenting your identity or using another user’s data without consent.

9. Termination

We reserve the right to suspend or terminate access to the Service at any time for violation of these Terms or misuse of the platform. You may cancel your account at any time through your dashboard or by contacting support.

10. Disclaimers and Limitation of Liability

CalmApply is provided "as-is" and without warranties of any kind. We make no guarantees regarding job placement, acceptance, or employer response. To the fullest extent permitted by law, CalmApply disclaims liability for any indirect, consequential, or incidental damages arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless CalmApply and its operators from any claims, losses, or expenses arising from your use of the Service, your data, or any violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Denver County, Colorado, unless otherwise required by law.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
